2 Validity
These General Terms and Conditions (hereinafter referred to as GTC) apply in the version valid at the time of conclusion of the contract for all orders, deliveries and services made via our online store treecalc.com.
By submitting your order from the shopping cart, you accept these GTC as binding.
These GTC apply regardless of whether you are a consumer, entrepreneur or merchant in the legal sense.
We do not accept deviating and/or supplementary agreements from the customer. This also applies if we do not expressly object.
3 Conclusion of contract
All offers in our online store are non-binding and subject to change. Minor deviations and technical changes to our illustrations or descriptions are possible.
By submitting an order for "Calcs" (calculation bonus points) by clicking on the "Buy Calcs" button, you are placing a binding order for the goods contained in the shopping cart. You are bound to this order for two weeks. Your right of withdrawal, if any, remains unaffected.
We save the data of your transaction.
A contract with us is concluded upon receipt of your payment.
We reserve the right to refuse your order at any time without giving reasons. In this case, if you have already made a payment, the amount paid will be refunded to you.
We use the personal data you provide during the order process to process your order.
4 Right of revocation
If you are a consumer in the legal sense, you have a right of revoke in accordance with the statutory provisions.
A consumer is a natural person who orders the Calcs for a purpose that cannot be attributed to a commercial or independent professional activity.

5 Prices
All prices stated in our online store are gross prices in euros and include the statutory German VAT.
6 Terms of payment
You can purchase bonus points for tree safety calculations "Calcs" against prepayment, or ask us to submit a quotation. To do so, please contact info@arbosafe.com
For advance payment, we accept the payment methods offered in our online store at the end of the order process.
You are not entitled to offset against our payment claims unless you have a claim against us that is undisputed by us or has been legally established.
7 Warranty
Users are fully responsible for entering parameters that are processed for calculations in the treecalc.com software using special algorithms. We do not assume any warranty or liability and reserve the right to change the calculation algorithms at any time. The respective calculation algorithm is marked with a version number after each calculation.
8 Liability
We accept no liability for the calculations.
Users are fully responsible for the calculations and the resulting conclusions.
9 Applicable law, place of jurisdiction
The contractual relationship between you and us shall be governed by the law of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you have placed the order as a consumer and have your habitual residence in another country at the time of your order, the application of mandatory legal provisions of this country shall remain unaffected by the choice of law made.
If you are a merchant in the legal sense or a corporation under public law and have your registered office in Germany at the time of the order, the place of jurisdiction for disputes arising from the contractual relationship with ArboSafe is exclusively in 82131 Gauting.
In all other respects, the statutory provisions apply to local and international jurisdiction.
10 Out-of-court dispute resolution
The European Commission provides a platform (OS) for online dispute resolution: http://ec.europa.eu/consumers/odr
Consumers have the option of using this platform to settle their disputes. The Consumer Dispute Resolution Act (VSBG) offers the possibility of out-of-court dispute resolution through the involvement of a consumer arbitration board. However, ArboSafe does not currently participate in such dispute resolution procedures.
